GENERAL TERMS & CONDITIONS:

• Retainer Fee Is Non-Refundable.
• Everyone must arrive to the studio 5 min. prior to their session time.
• Any lateness of 6 minutes you will lose your appointment.
• Everyone must arrive dressed and ready to start (For these photos you must wear nude, white or black underwear according to your preference and you must wear it.)
• Delivery of Goods: On average; our delivery times vary from 2 to 3 weeks, you will receive an email with a link from the WeTransfer site to download the files from your computer (not from a cell phone).

By purchasing a time slot, you agree that you have read and understand the package details, terms and conditions. In addition to the general terms and conditions detailed below:

Model Release
I grant to the Photographer, Patricia Carrozzini, the right to take photographs of myself, my children and my property as deemed fit by the photographer. I authorize the photographer, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that the photographer may use such photographs of me with or without my name and for any lawful purpose; including for example such purposes as publicity, illustration, advertising and web content, as well as contests or exhibitions, without my consent and without my obtaining any monetary benefit.
Refunds
The reservation deposit is non-refundable. If your digital images are damaged or lost prior to viewing your gallery for any reason by the photographer, only then will your retainer fee will be refunded in full. There are no refunds or exchanges on any digital products. The Photographer cannot guarantee a specific number of images provided to the client, and no refund will be given due to lack of subject cooperation.
Copyright & Reproduction
The Photographer shall own the copyright in all images created and shall have the exclusive right to make reproductions for, including but not limited to, marketing materials, portfolio
entries, sample products, editorial submissions and use, or for display within or on the Photographer’s website, blog, facebook pages, and/or studio. It is understood that any duplication or alteration of original images is strictly prohibited without the written permission of the Photographer.
All images are copyright under the Federal Copyright Laws and subject to fines of up to $150,000 if breaking those laws. By signing this contract, you are agreeing not to copy, save, or reproduce images in any way. This includes copying and saving images from the website, blog, Facebook, or any other form of advertisement.
Client's Usage
The Client shall only use the images, including digital files, in accordance with the permissions within this agreement. The Client’s images are for personal use only and shall not be submitted to contests, reproduced for commercial use or authorize any reproductions by parties other than the Photographer. If the Photographer provides a digital file print release, the Client must act in accordance with the release.
Negligence
If negligence on the client's part, the part of any above named models, or the part of any individuals that accompany the client to the photo session causes anyequipment, props, or any of the photographer's property to malfunction or become damaged, that the client will be liable for the cost to repair or replace said item(s).
Safety and Personal Accidents
Divine Portraits LLC and Patricia Carrozzini, are not responsible for any accident or damage caused by the clients to themselves or by a third party during a photo or video session, whether these are caused by the use of any accessory, any complement used, equipment, por transportation, or by a contracted external service. Any instructions given to clients, their guests, or employees before or during the session, are considered and executed at your own risk. In addition, the client or each individual is responsible for theirs own safety and for the decisions theirs makes for the realization of theirs photographic or video session.
